1. Introduction

The Easy Quit website is owned and operated by Easy Quit Health Pty Ltd, ACN 690552651, a company incorporated in Australia. These Terms of Service (“Terms”) govern your access to and use of the Easy Quit website and telehealth service and platform (“Easy Quit”, “we”, “us”, “our”).

By accessing or using our services, you agree to be bound by these Terms.

Easy Quit provides telehealth healthcare services delivered by independent Ahpra-registered practitioners. Easy Quit facilitates consultations, administrative support, and payment processing. Clinical care, including medical advice and prescribing, is provided by the consulting practitioner.

These Terms of Use affect your legal rights and obligations so please read them carefully. If you do not agree to be bound by these Terms of Use, do not use our website.

2. Services

Easy Quit provides telehealth healthcare services for smoking cessation and nicotine dependence.

These services may include:

  • completion of intake and identity verification

  • booking and attending medical consultations

  • clinical assessment and treatment planning

  • prescribing where clinically appropriate

  • follow-up consultations and ongoing support

Easy Quit also provides administrative, technology, communication, and payment facilitation services in connection with the delivery of care.

Any dispensing of prescribed medication is undertaken by an independent licensed pharmacy.

3. Eligibility

To use our services, you must:

  • be at least 18 years of age (unless otherwise permitted by law and clinically appropriate)

  • provide accurate and complete information

  • complete identity verification requirements

We may refuse or discontinue services if eligibility requirements are not met.

4. Clinical Care and Practitioner Independence

Clinical care delivered through Easy Quit is provided by Australian-registered medical practitioners.

Easy Quit provides the service framework through which care is delivered. However, each consulting practitioner is solely responsible for:

  • clinical assessment and diagnosis

  • prescribing decisions

  • treatment recommendations

  • medical record keeping

  • follow-up and ongoing care decisions

Easy Quit does not direct practitioners to prescribe any particular treatment or make specific clinical decisions. Practitioners are responsible for complying with all applicable professional standards, guidelines, and regulatory requirements

5. No Guarantee of Treatment or Prescription

Payment of a consultation fee does not guarantee that:

  • any medication will be prescribed

  • any specific treatment will be recommended

  • a prescription will be issued

All clinical decisions are made independently by the consulting practitioner based on professional judgment and clinical appropriateness.

6. Identity Verification

You must complete identity verification prior to accessing consultations.

You agree that:

  • all information provided is accurate and complete

  • you are the person attending the consultation

We may suspend or refuse services where identity cannot be verified.

7. Fees and Payments

Consultation fees are displayed prior to booking and are payable upfront.

By proceeding with a booking, you agree to pay the stated consultation fee.

Additional costs may arise if treatment is prescribed, including pharmacy-related costs.

Where payments are facilitated through the platform for third-party services, Easy Quit may act as a payment collection agent only and does not itself supply those services.

8. Payment Agent Arrangement

Easy Quit may facilitate payments for services and, where applicable, payments related to prescriptions or pharmacy services.

Where you choose to use integrated payment functionality, you acknowledge and agree that:

  • Easy Quit acts as a limited payment collection agent for the relevant third-party provider (which may include a medical practitioner or licensed pharmacy)

  • payment made through the platform is deemed to be made directly to the relevant provider at the time of payment

  • Easy Quit does not take ownership of, supply, or sell any therapeutic goods

  • Easy Quit does not control pricing, availability, or dispensing decisions of any pharmacy

You authorise Easy Quit to:

  • collect payments on behalf of the relevant provider

  • deduct disclosed platform or service fees

  • remit the remaining amount in accordance with its arrangements

Easy Quit is not a party to any contract for the supply of therapeutic goods. Any such contract is between you and the dispensing pharmacy. Funds collected by Easy Quit in this capacity are held on behalf of the relevant provider and do not constitute revenue of Easy Quit, except to the extent of any disclosed platform or service fees

9. Prescriptions and Therapeutic Goods

Easy Quit does not manufacture, supply, or dispense therapeutic goods.

Where clinically appropriate, a practitioner may issue a prescription in accordance with Australian law.

You may choose where to have your prescription dispensed.

Any dispensing, supply, and delivery of medication is carried out by a licensed pharmacy independent of Easy Quit.

Easy Quit does not guarantee:

  • availability of any medication

  • suitability of any treatment

  • outcomes of any therapy

10. Pharmacy and Third-Party Services

If you choose to use a pharmacy or third-party provider:

  • you enter into a separate arrangement with that provider

  • their terms and conditions apply

Easy Quit is not responsible for:

  • pharmacy operations or conduct

  • medication supply, delivery, or availability

  • third-party services or outcomes

11. Refund Policy

If a consultation cannot be completed due to a technical issue or clinician unavailability, you may be offered:

  • a rescheduled consultation, or

  • a full refund

If a consultation proceeds, a refund will generally not be provided solely because:

  • no prescription was issued

  • a particular treatment was not recommended

A consultation is considered to have been provided where a clinical assessment has been performed, regardless of the outcome. Refunds may be considered on a case-by-case basis.

12. User Responsibilities

You agree to:

  • provide accurate and complete information

  • follow medical advice provided by your practitioner

  • use the service lawfully and appropriately

You must not:

  • provide false or misleading information

  • attempt to obtain medications dishonestly

  • misuse or interfere with the platform

13. Privacy

Your personal information is handled in accordance with our Privacy Policy.

By using our services, you consent to the collection, use, and disclosure of your information as described in that policy.

14. Limitation of Liability

To the extent permitted by law, Easy Quit is not liable for:

  • clinical decisions made by practitioners

  • treatment outcomes or adverse effects

  • actions or omissions of third-party providers

Nothing in these Terms excludes, restricts, or modifies any rights or remedies you may have under the Australian Consumer Law or other applicable laws that cannot be excluded. Services are provided with due care and skill in accordance with applicable professional standards.

15. Service Availability

We aim to provide continuous access to our services but do not guarantee uninterrupted availability.

We may suspend or modify services for maintenance, operational, or legal reasons.

16. Changes to Terms

We may update these Terms from time to time.

The current version will be published on our website. Continued use of the service constitutes acceptance of the updated Terms

17. Governing Law

These Terms are governed by the laws of Victoria, Australia.

Any disputes will be subject to the jurisdiction of the courts of Victoria.
